Defense Lawyer Asserts Lack of Evidence in Case of Nurse Who Strangled Three Children

Lindsay Clancy’s attorney, Kevin Reddington, argued during a Tuesday court hearing that there was insufficient evidence to prove his client killed her three children. The claim followed Clancy’s murder trial earlier this month, which ended in a mistrial due to a deadlocked jury.

Clancy, 36, and a former labor and delivery nurse, faces charges for the deaths of her three young children—5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan—in 2023. Reddington did not dispute that Clancy killed her children but contended there was inadequate evidence to establish criminal liability.

“This entire case is based on speculation,” Reddington stated in court.

Prosecutors have maintained that Clancy knowingly used exercise bands to strangle her children and had schemed to send her husband out of the house that evening by having him pick up medicine for one child and dinner for the family.

Plymouth County District Attorney Timothy Cruz indicated prosecutors have not yet decided whether to retry Clancy on first-degree murder charges, lesser offenses such as second-degree murder or manslaughter, or drop the case entirely. Cruz emphasized, “We are going to do what we can for the children.”

Clancy’s defense also sought dismissal of the criminal case, arguing that one juror who favored a murder conviction should have been dismissed after he refused to listen to the law on reasonable doubt. The jury was split 11 to 1 in Clancy’s favor.

The holdout juror, Michael Desronvil, told Fox News’ “Hannity” that he had no doubts about his stance and stated, “the whole focus has been on me, but we want to reel everything back and put the focus on the three angels.”

Clancy remains charged with murder and is expected to stay at a psychiatric facility until her case is resolved. If convicted, she could be sentenced to life in prison; if acquitted, the judge may order her confinement in a mental health facility.
