Marcus Terry, 43, was found guilty last December of second-degree murder for killing his cellmate Ray Matos at Dade Correctional Institute in Homestead. During a recent court hearing on Tuesday, the convicted killer was caught on video smiling and giggling as Judge Ellen Sue Venzer described the brutal details of the crime.
The judge recounted that the victim was stabbed in the brain with a pen, had a pillowcase shoved into his mouth, and was found standing over him with a bloodied hand when guards arrived. During this description, Terry began to smile and giggle.
When Judge Venzer asked, “I’m not sure why you’re laughing,” Terry responded: “You are amusing.”
The judge stated she found nothing amusing in Terry’s behavior or the death of the victim and denied his attorney Steven Yermish’s motion for a new trial. She sentenced Terry to life without parole.
Terry had already been serving a life sentence for armed burglary and armed robbery when he killed Ray Matos, who was his cellmate for less than a week.
